CONDITIONS AND RENTAL AGREEMENT - ENGLISH
Access to the reserved Villa is only possible for persons who have received written confirmation of their reservation and after receipt of a deposit of at least 40% of the confirmed total amount within a maximum period of fifteen days from the confirmation date. For reservations made one month before the arrival date, the full rental price is due upon confirmation. VILLA-ANNELY reserves the right to cancel any reservation for which the deposit or full payment has not been received. Payments must be made by bank transfer to VILLA-ANNELY or any other natural or legal person designated by VILLA-ANNELY.

BALANCE PAYMENT
The balance must be paid no later than three weeks before the start date of the stay. Failure to pay the balance by the due date will result in the immediate cancellation of the reservation, notified to the client by email.

CANCELLATION BY THE TENANT
Cancellations requested by the client, for any reason, are subject to variable penalties depending on the date the written notification by registered letter with acknowledgment of receipt (LRAR) is received by VILLA-ANNELY before the start date of the stay:

• More than 60 days before rental start: 10% of the rental price.
• 60 to 45 days before rental start: 25% of the rental price.
• 45 to 30 days before rental start: 50% of the rental price.
• Less than 30 days before rental start: 100% of the rental price.

CANCELLATION BY VILLA-ANNELY
Any cancellation or modification of a confirmed and paid reservation will be notified to the client and will result in a full refund of the amounts already paid. Whenever possible, VILLA-ANNELY will offer the client an alternative solution of the same or higher category, at no additional cost.

AVAILABILITY OF THE RESERVED VILLA
The reserved Villa is made available to clients, in whole or in part depending on the selected option, from 3:00 PM on the day of arrival and must be vacated by 12:00 PM on the day of departure. In case of late departure, luggage may be stored at the Villa reception under the responsibility of the clients. Upon arrival, clients must complete a police registration form in accordance with applicable hotel regulations.

RENTAL CONDITIONS
Pets are not allowed. The reserved Villa is rented only as a temporary residence for leisure purposes; subletting is prohibited.

Damage to furniture or equipment will be charged at replacement value. Likewise, broken or damaged objects, furnishings, or equipment that show excessive wear for the rental period will be subject to reimbursement at actual cost. The client must report any damage to the Villa, its outbuildings, or accessories immediately upon discovery. The client cannot refuse an inspection of the premises when requested by VILLA-ANNELY or its representative. An inventory and condition report will be established at the beginning and end of the stay. The security deposit will be returned on the day of departure, after deduction of any amounts due for repairs or additional charges.

LIABILITY
VILLA-ANNELY and its staff disclaim any liability for incidents/accidents and their direct or indirect consequences that may occur to property and/or persons (clients, residents, guests) in the rented Villa or within its premises. Their liability cannot be sought under any circumstances.

VILLA-ANNELY expressly informs clients, residents, and guests that private and communal swimming pools, children’s play areas, and sports facilities (tennis, football, handball, basketball, pétanque, etc.) are not supervised. Their use is at the sole responsibility of clients, residents, and guests.

We strongly advise special caution when using swimming pools with children. Children are under the sole and entire responsibility of their parents or the resident clients who supervise them. Clients and residents must not allow children to use the swimming pools, play areas, or sports facilities unsupervised and acknowledge full responsibility in this regard. Likewise, VILLA-ANNELY cannot be held liable for any interruptions or failures in services such as water, electricity, etc.

Personal belongings are the sole responsibility of clients/residents. However, safes are available in the reserved Villa for valuables. If VILLA-ANNELY is found liable by a final court decision, the compensation amount may not exceed the total rental cost paid by the client.

GUESTS
Only owners and clients have permanent access. Clients must notify the manager of any guest they wish to invite no later than the day before their arrival. Full identification of guests will be required and may be verified. The manager and the estate’s security personnel have the right to refuse entry to any guest without justification, even if prior approval was granted. This contract and the estate’s internal regulations apply to all guests. Visitors are allowed until 10:00 PM; after this time, access is prohibited for security reasons.

TERMINATION
The mere signing of the booking confirmation implies, from the client as well as all residents and guests staying in the Villa, unconditional acceptance of these general terms and conditions, which form an integral part of the rental contract. Non-compliance with the general terms and conditions may result in the immediate, automatic, and uncompensated termination of the rental contract. In such a case, clients, residents, and guests must vacate the reserved Villa within two hours of notification by the manager.

PAYMENT DEFAULT
Any failure to make a payment by the due date will result in immediate enforcement of the outstanding amount without the need for a reminder. Additionally, late payment interest will be automatically applied at a rate equal to the refinancing rate of the European Central Bank, increased by ten (10) percentage points, in accordance with Article L.441-6 of the French Commercial Code. If the debtor is a business, they will also be liable for a fixed compensation of €40 per unpaid invoice for collection costs, as well as any additional compensation under Article L.441-6 of the French Commercial Code.

PENALTY CLAUSE
In accordance with Article 1231-5 of the French Civil Code, in the event of non-payment of any amount due by its due date, the defaulting debtor shall automatically and without prior notice be liable for a penalty of 15% of the total amount due, with a minimum charge of €250. This penalty only covers damages resulting from the delay, and VILLA-ANNELY reserves the right to take further legal action against the defaulting debtor.
